What documents does the National Criminal Record deliver?

The National CriminalRecord only issues extracts from criminal records.

There are threetypes of extracts:
- bulletin no. 1 ,issued only to courts,
- bulletin no. 2 ,issued only to administrations and certain authorized bodies,
- bulletin no. 3 ,the only document issued to individuals.
 
The National Criminal Records Office can issue, on request, a form for anational of French nationality with a criminal record extract (bulletin no. 3)none. This form accompanies bulletin no. 3 nil. It is written in French andtranslated into the official language of the State where it is presented. Thisdocument is issued within the framework of the regulationof July 6, 2016 aimed at promotingthe free movement of citizens by simplifying the conditions for presentation ofcertain public documents in the European Union. Thus, the presentation of thisform with bulletin n°3 nil exempts French citizens from the apostilleformality, when they wish to present it to an administration of another Stateof the European Union.

What is the criminal record?

The criminal record is therecord of the criminal convictions of a person referenced in the NationalCriminal Record. The information contained in the criminal record iscommunicated in the form of extracts called criminal record bulletins. Thethree types of extract are:
- bulletin no.1,
- bulletin no.2,
- bulletin no.3.

The criminal record stores the convictions handed down by the criminal courts(assize courts, assize courts minors, courts of appeal, criminal courts, policecourts, children's courts, children's judges). It also preserves certaindecisions pronounced by commercial courts (personal bankruptcy, commercial ban)and certain administrative and disciplinary decisions when they enact or resultin incapacities even when they have not been pronounced. Some convictions canbe withdrawn.

A person may, upon written request to the public prosecutor of the judicialcourt of his domicile, obtain a communication of the full statement of hiscriminal record. No copies may be submitted.

What doescriminal record bulletin no. 1 contain?

Bulletin No. 1 of the criminal recordcontains all the convictions and court decisions contained in the criminalrecord.

However, are excluded:

immediately:
- convictions benefiting from amnesty,
- convictions benefiting from judicial rehabilitation with removal of thecriminal record,
- declarations of criminal irresponsibility when compulsory hospitalization orsecurity measure has expired,
- commercial or disciplinary sanctions erased by rehabilitation,
- foreign convictions whose withdrawal has been ordered by a court.

at the end of a period of 3 years:
- convictions handed down for police infractions,
- the period is however 4 years for those whose recidivism constitutes an offense,
- convictions accompanied by an exemption from sentence , unless the court hasordered non-registration,
- sanctions or educational measures, except in the event of a new measure orconviction during this period,
- criminal compositions, except in the case of a new composition or criminalconviction during this period.

at the end of a period of 5 years:
- personal bankruptcy or disqualification from management unless their durationis greater than 5 years.

The request for this bulletin is reserved for the judicial authorities and theregistries of penitentiary establishments in the context of the investigationof certain measures of execution of the prison sentence.

What doescriminal record bulletin no. 2 contain?

Bulletin No. 2 includes most convictionsfor crimes and misdemeanors, with the particular exception of:

- convictions benefiting from judicial or automatic rehabilitation,
- convictions handed down against minors,
- convictions handed down for police infractions,
- suspended sentences, when the probation period has ended without a newdecision ordering the execution of the entire sentence, unless socio-judicialmonitoring or a penalty of imprisonment has been imposed. prohibition fromcarrying out a professional or voluntary activity involving habitual contactwith minors or a sentence of ineligibility of a longer duration.

Bulletin No. 2 also includes convictions handed down by foreign courts againsta French person, with the exception in particular of convictions handed downagainst minors.

This bulletin can only be issued to certain administrations for specificreasons (for example, to access a job in contact with minors). Certain privateemployers also have access to it for the same reasons.

Information : it is possible to ask the judge,either at the time of sentencing or through a subsequent request, that theconviction not be entered in bulletin no. 2. If the request is accepted, theconviction will remain entered in bulletin no. 1.

海牙认证总包费用为3500元人民币，使馆认证总包费用为4000元人民币（特殊国家除外，以咨询为准）。总包费用包含了政府外事机构、使馆机构等第三方机构的费用、认证文件快递回国的国际快递费用。部分国家认证需要国际快递邮寄申请人本人原始签字表格和材料的，或者材料有疑问，需要补交相关证明材料的，需要自付自己邮寄原始签字表格和材料或者补充材料的国际快递费用。海牙认证和使馆认证工作一般不会同时进行，需要二选其一。
